General Conditions of Use
This agreement
Please read this agreement carefully before using Australian JobSearch. By using JobSearch, you agree to be bound by these Conditions of Use. We may change this agreement at any time. Any change to this agreement becomes effective once it has been posted on JobSearch.
When you accept these Conditions of Use, you are making an agreement between yourself and the Commonwealth of Australia in which you agree to follow all rules associated with using JobSearch.
You must not provide any information that you know is false or misleading as stated in the Criminal Code Act 1995. If you do give false or misleading information, or if you leave out information so that information you do give is misleading, appropriate action will be taken against you.
Job seekers, employers and employment service providers must accept and abide by their specific Conditions of Use for using JobSearch.
Website owner
JobSearch is owned, managed and maintained by the Department of Education, Employment and Workplace Relations (DEEWR).
DEEWR has the right to:
- decide what information is displayed on JobSearch
- remove any information which does not meet the Conditions of Use or does not comply with relevant laws, and
- gather and use feedback from users of JobSearch to help improve and develop JobSearch.
Purpose of JobSearch
JobSearch is a free website that enables job seekers, employers and recruitment agencies to meet their employment requirements.
JobSearch cannot be used to lodge training courses, gather information or conduct surveys.
Compliance with laws
You are responsible for abiding by Commonwealth, State and Territory laws when using JobSearch.
We will immediately remove any vacancies that we consider are breaking any law.

All material displayed on JobSearch is subject to copyright. No unauthorised use is permitted.
Third party copyright
If you wish to put material on JobSearch that you have not written, you must have permission of the copyright owner before using their material.

By placing material on JobSearch, we are not providing professional advice.
We do not guarantee the accuracy or reliability of any of the material placed on JobSearch.
Material on JobSearch may include the views or recommendations of others that are not necessarily our views.
You should make your own enquiries to check if material on JobSearch is accurate and reliable.
Links to other websites are provided for your convenience. We do not endorse material on those websites, or any associated organisation, product or services.

Access
We try to make sure that JobSearch is available for you when required. However, we cannot guarantee that there will not be any interruptions while you are using the site.
We also cannot guarantee that JobSearch, or software downloaded from it, is free of computer viruses.
Security
We try to provide a secure internet environment but there are still risks associated with exchanging information via the internet. You need to decide if you think websites linked from JobSearch are secure prior to accessing those websites.
Indemnity
You will indemnify (and keep indemnified) DEEWR, its officers, employees and agents against any loss or expense (including legal expenses) resulting from any claim or action resulting from any wilful, unlawful or negligent act or omission by DEEWR or DEEWRs employees, agents or subcontractors in connection with JobSearch.

Employment Service Providers Job Placement Organisations (JPOs) Conditions of Use
In addition to your contractual obligations under the terms of the Job Placement Licence 2006-2009, JPOs are also bound under these Conditions of Use.
Employers/Job Placement Organisations (JPOs) code of conduct
You must:
- avoid any practice or activity that could bring JobSearch into disrepute
- comply with all relevant Australian laws
- NOT use Find Staff to get personal details for your own employment agency database
- provide an Australian Business Number (ABN) where available before lodging a vacancy
- make sure job seekers are offered conditions that are stated in your vacancy
Note: Arrangements will NOT be made for bulk downloading of resumes.
Applicability of legislation
You should seek your own legal advice regarding the applicability of legislation.
Monitoring of job vacancies
The information on JobSearch is on a computer system funded by the Commonwealth of Australia. The Commonwealth of Australia has the right to refuse access to this service.
We have the right to remove vacancies if we believe they do not meet our Conditions of Use.
Vacancies are checked by staff contracted to us and will not be uploaded on to JobSearch if they do not meet our Conditions of Use. Information that is considered false, misleading, offensive or unlawful will not be displayed and will be removed from the system. If you do not comply with these conditions, you may be refused future access and the matter may be referred to the appropriate authorities for further action.
JobSearch is always monitored to ensure currency of vacancies. Vacancies automatically removed without notification include vacancies that:
- do not have a referral result or expected-to-start date
- have a creation date of more than 30 days or have not been updated within a 14-day period (for jobs placed by JPOs)
- have a creation date of more than 32 days (for jobs placed by public employers).
If we receive a complaint about your vacancy, we may remove the vacancy from JobSearch while investigating the complaint. If we find that the vacancy does not meet our Conditions of Use, you may be denied future access to JobSearch. Serious breaches will be referred to the appropriate authorities for further action.
By using JobSearch, you consent to our monitoring. This may include recording your domain name, server, address and the pages viewed by you. Where you have requested access to a secure part of JobSearch, your User ID will be recorded. Where you send a message or submit a form, your email address will be recorded.

Vacancy requirements
Please note that vacancies lodged by public employers directly via the internet normally appear on JobSearch within two to 48 hours. All vacancies lodged by public employers must go through quality assurance checks to make sure that they meet these Conditions of Use prior to being uploaded.
These requirements apply to everyone.
In order to lodge a vacancy, you must have included in your registration: the name of the employing business, a contact name, a street address and a landline phone number we can contact you on about your vacancies. A mobile number can be supplied as an additional alternative form of contact but vacancies with mobile numbers alone will not be accepted.
Please note: the details described above will not be displayed on your vacancy unless you include them in the job description.
You must make sure that vacancies you lodge on JobSearch:
- provide a clear and accurate description of the nature of the work, including details of the service or product involved
- clearly state if the job seeker will need to provide their own transport to undertake the duties of the position
- clearly state if the job seeker will need their own transport to travel to and from work
- state the hours of work, either the set number of hours the employee will work, or minimum hours an employee could expect to work
- are identified as anticipated vacancies for vacancies you are expecting to have available. An anticipated start date must also be entered. This is done by selecting the anticipated vacancy box on the vacancy conditions page
- are free of spelling mistakes and are grammatically correct
- do NOT include a request that the job seeker provide a photograph of themselves with their application or at their interview.
If you require a job seeker to have a pre-employment medical or drug/alcohol test, the requirement must be relevant to the type of work the applicant will be doing and must not breach any State or Territory anti-discrimination legislation. This requirement must also be stated in the vacancy description (i.e. must be able to pass a full medical).
Wages information
Please note the following advice:
- We suggest you include some indication of the wages for each position. Where possible, provide the name of the industrial arrangement/agreement/award, an indication of the salary range or hourly rate.
- If the wage is to be negotiated, an indication of the salary range or hourly rate should be stated.
- Government pensions are not acceptable wages.
- If salary is partly or wholly commission based, the rate of commission should be stated including a retainer if applicable.
- If your position has youth wages, you must make sure there is applicable legislation or an award that allows for the payment of youth wages in relation to the position.
- Clearly identify independent contracting or sub-contracting business arrangements in the vacancy within the Description field.

Unacceptable vacancies
We have the right to classify any vacancy as unacceptable for display on JobSearch, including those that could bring JobSearch into disrepute. Some examples are:
- vacancies that breach Commonwealth and or State/Territory legislation (e.g. discriminatory vacancies)
- vacancies that breach these Conditions of Use
- vacancies that involve activities, products or services that may be considered offensive, illegal or misleading
- vacancies involving any form of nudity or work in the sex industry
- training courses
- pyramid selling schemes
- vacancies that do not provide full details of the job, product or service involved
- vacancies that involve promotion of gambling or gambling websites
- vacancies where the contractual arrangements relating to the position are not covered by an Australian Industrial Relations Agreement
- vacancies that do not clearly specify all costs to be incurred by the job seeker.
Additional requirements for multi-level marketing, self employment, business opportunities and commission work
You CANNOT use the find staff feature on JobSearch to search for job seekers to fill your vacancy. You must:
- identify your vacancies as Self Employment, Business Opportunity, Multi-Level Marketing or Commission by selecting the appropriate job type when lodging your vacancy
- specify the nature of the business
- clearly state any amount the job seeker will need to invest or pay upfront, and the continuing fees for the product, equipment purchases or any other costs
- sell a legitimate product
- list the full details of the product or service involved
- explain the duties involved
- provide details of wages including commission rate and retainer (if applicable) and method of payment
- provide a range of likely earnings.
Additional requirements for independent contractors
Vacancies for independent contractors or sub-contractors must include items that are required to be supplied by potential candidates in the vacancy description field. You must also make it clear that the work is to be performed under independent contracting or sub-contracting arrangements and wages are subject to negotiation.
Additional requirements for work from home positions
If your vacancy requires the job seeker to work from home, your vacancy must include:
- the nature of the employment (e.g. will the job seeker be working as an employee or an independent contractor)
- how the job seeker will be paid (e.g. commission based, hourly rate, etc) including details or superannuation
- details of who will be responsible for workers compensation and other relevant insurances, if applicable
- the duration of employment (if non-ongoing) and anticipated daily working hours
- information about the deduction of income tax (e.g. do you withhold income tax or does the worker pay their own income tax)
- details and cost of any equipment the job seeker will need to supply
- details of any other costs the job seeker will be expected to pay.
Additional requirement for Green Corps positions
You must identify Green Corps positions by selecting the appropriate vacancy job type when lodging your vacancy. The vacancy description field must specify the Government programme that is funding the positions; the nature and period of the training; details of any off the job training involved; the training wage applicable, and whether employment is available at the end of the training.
You must specify Green Corps in brackets after job title.
These positions are not counted in the job count on the JobSearch homepage.
Additional requirements for overseas employment
Overseas employment will only be accepted when Australian based employers lodge the vacancies and there is a requirement for the employee to work overseas. You must place the employee on an Australian Industrial Relations Agreement. The employee must remain under an Australian Industrial Relations Agreement for the entire time they are on the overseas placement.
You must include full details of the travel, wages, accommodation and period of the overseas placement in the vacancy description field.
Expiry of vacancies
It is important that all vacancies on JobSearch are current. Vacancies which are not current should be closed or inactivated.
Vacancies that do not have a referral result, an expected-to-start date or have reached their maximum allowed display period will automatically be removed.
Vacancies lodged by public employers directly via the internet will have a default to remain on display for 14 days or up to a maximum of 32 days.
Vacancies lodged by Job Placement Organisations (JPOs) will remain on display for 30 days from creation, or 14 days from the last update, whichever is the later date, where a referral exists with a result of:
- Placed
- Not placed
- Failed to report to appointment
- Created in error.
Vacancies lodged by JPOs will be left active where a referral exists with a result of:
- No result
- Expected to start.
Migrant friendly vacancies
Vacancies lodged as a migrant friendly vacancy will be displayed and automatched to Australian job seekers for the first 28 days. After that time the vacancy will be automatched to both Australian and skilled migrant job seekers for the next 32 days.
Job seekers conditions of use
How does JobSearch work?
JobSearch lets you search for jobs and create or upload your resume(s).
The information provided by you will be used for automatic matching against jobs advertised on JobSearch and by employers searching for employees.
By registering with JobSearch you are agreeing to have your resume publicly displayed via the internet and agree to receive notification (via email, your personal profile or, if applicable, SMS) from JobSearch relating to job matches, the use of the website and other relevant employment matters.
Job seekers rules for using JobSearch
The following rules apply for job seekers using JobSearch:
- You must be an Australian citizen, resident or have an appropriate visa to work in Australia to register and use the resume and job matching part of JobSearch.
- You must be allowed by law to work (for example, meeting minimum age requirements in your state or territory) before you lodge a resume.
- When you stop using JobSearch to find a job, you must remove your resume(s).
- If any of your details change (for example, address, phone number and skills) you must update your details and/or advise your Job Network member (JNM) of these changes within 24 hours.
- You must not provide any information that is likely to be considered false, misleading, offensive or unlawful. If you do, this information will not be displayed and will be removed from the system. You may be refused future access to JobSearch and, if appropriate, have your details given to appropriate authorities.
- In order for you to be automatched to jobs, you must have at least one resume on the system.
Putting a resume on JobSearch
To upload a resume on JobSearch you will need to save your resume as a Rich Text Format (RTF) document. You can do this by clicking on the Save as type dropdown box when saving your resume.
If your resume has any information that is considered false, misleading, offensive or unlawful, it will not be displayed and will be removed from the system.
You cannot include any images (such as pictures of yourself) in your resume. The system will block resumes containing images from being uploaded.
People with sensitive job seeker records (for example, those under witness protection) whose personal details must not be displayed cannot upload their resume(s).
Expiry of resumes
If you are a public job seeker (i.e. you do not receive any Government assistance) your resume(s) will stay on display for 90 days from the date you view or change your details. After this time it will be removed from the system.
Resumes created by Job Network members (JNMs) for Job Search Support Only (JSSO) job seekers will stay on the system for 91 days from the date viewed or changed, after which time they will be inactivated on the system.
Resumes created by JNMs for Fully Job Network Eligible (FJNE) job seekers will remain on the system until you are no longer in receipt of a Government allowance.
Job seeker privacy
No personal details will be shown on JobSearch unless you choose to include them. Your identity will remain anonymous. If you are registered with a Job Network member and have a sensitive job seeker record (for example, you are under witness protection), your personal details will not be displayed on JobSearch and cannot be viewed by any other parties.
Any information provided in resumes you upload or create on the website can be viewed by Job Network members and Job Placement Organisations. These organisations are bound by contract to protect your privacy in regard to any information you put on the website.
JobSearch will not provide you with the names of employers who have accessed your resume(s) online.
